This web site is provided by Eleet Fitness. By using the site or downloading materials from the site, you agree to abide by the terms and conditions set forth in TERMS AND CONDITIONS.

I am willingly and knowingly becoming a member of Eleet Fitness. I also acknowledge that I am willingly and knowingly participating in an Exercise Program (“Program”) offered by Eleet Fitness. To induce Eleet Fitness to accept me as a participant in the Program, I represent and agree as follows:

1. MEDICAL HISTORY: I have made the decision to participate with full knowledge of my medical history and current medical status and, therefore, hold Eleet Fitness harmless from any injury, advancement of illness, or death from participation in activities or any negligence on its part.

2. RELEASE: I understand the nature and purpose of the Program and am aware that any strenuous physical activity involves certain risks. I specifically acknowledge that risks of death or injury to me, or damage or loss of my property, are inherent in the activities I am to be engaged in with respect to Eleet Fitness and hereby agree to assume said risks, and all other risks and liabilities. I release, discharge and absolve Eleet Fitness, its officers, directors, employees and their parents, affiliates, and subsidiaries from any and all liability or responsibility for any such accident or injury except to the extent such accident or injury is caused by or results from the negligence of Eleet Fitness, its officers, directors, employees and/or agents. This release shall be binding upon my heirs, executors, administrators and assigns.

3. MEMBERSHIP: Membership cannot be assigned or transferred to another person. You agree not to modify, copy, distribute, transmit, display, reproduce, publish, license or otherwise use the content of the Eleet Fitness website.

4. PRIVACY: I understand that Eleet Fitness may from time to time use statistical, medical or other data obtained during the course of the Program for professional purposes (names will be undisclosed) and I hereby consent to such use. Such information will remain confidential and will not be shared with any outside entity.

5. COPYRIGHTS AND TRADEMARKS: The entire content included in this Site, including but not limited to text, design, graphics, interfaces, or code and the selection and arrangements thereof is copyrighted as a collective work under the United States and other copyright laws, and is the property of Eleet Fitness.

6. MATERIALS: Eleet Fitness will not be liable for any damages or injury. User acknowledges and agrees that the use of the materials and the website is at their own risk.

7. WEBSITE PARTICIPATION: Eleet Fitness does not and cannot review all communications and materials posted to or created by users accessing the site and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user generated content on the Site, Eleet Fitness is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the Site. However, Eleet Fitness reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) violates any law or regulation or (e) offensive or otherwise unacceptable to Eleet Fitness at its sole discretion.

8. SAFETY: For my safety, I agree to abide by all rules and regulations of the Program and Eleet Fitness and as same may be changed from time to time.

I have read this TERMS AND AGREEMENT and understand all its terms. I execute it voluntarily and with full knowledge of its significance.
